Hereford Protester Found ’Not Guilty’

Argyll and Bute District Court in Helensburgh near Glasgow heard yesterday how anti-nuclear protester, Joss Garman (17), a student at Hereford Sixth Form College, had attended a mass demonstration against nuclear weapons at H.M. Naval Base on the Clyde last February. There he was accused of blocking traffic trying to enter the base and was charged with a ’Breach of the Peace’.

In court, Garman, representing himself, argued under the United Nations Convention on the rights of a child. This states in article 15, paragraph 1, that the child has the right to "freedom of peaceful assembly."

The JP found the accused ’Not Guilty’ of the charge. Garman, who is a member of the non-violent direct-action group, Trident Ploughshares, said, "I am happy with the outcome of this trial. However, I think that it is immediately necessary that this court starts to realize that Trident is the crime, and that my colleagues and I are upholding International law as global citizens trying to prevent the plotting of mass genocide."

The protester, who has been arrested several times in relation to environmental and peace issues, will appear again before the same court on 29th October charged with a separate alleged offense. This time relating to the painting of anti-war slogans on the side of a bridge near the entrance to the military base during the Trident Ploughshares International Disarmament Camp in August.
