Prosecution Claim "No Lawful Excuse" in Fylingdales Trial

As the prosecution began its case today in the York Crown Court trial of two women accused of intent to cause damage at US Fylingdales Ballistic Missile Early Warning Station in Yorkshire, it claimed that the defendants had no lawful excuse for their intended actions.
Sylvia Boyes, 57, from Keighley in Yorkshire and Olivia Agate, 64, from Skipton are charged with intent to cause criminal damage after being apprehended by MOD police on 28th March this year as they reached the perimeter fence of the base.
Prosecutor Helen Gamble said that no excuse existed since no crime was being committed at Fylingdales. All the major facts and the womens’ intentions had been admitted. There was no defence.
The second Crown witness, Sergeant Carr of the Ministry of Defence Police, duty station officer on the night in question, told the court how Sylvia had told him that their intention had been to cut through the fence and damage the radar arrays. She showed him a pair of bolt-croppers, a hammer, a banner and a statement. He recalled that the statement referred to the bombing of Hiroshima and Nagasaki.
Earlier, as the jury was selected Justice Taylor was at pains to let potential jurors know that they should rule themselves out if they had a connection to the base or to the Trident system.
The prosecution case continues and the trial is expected to last at least until Thursday
