TP Defences in Court

I, FRANCIS A. BOYLE, depose and declare under penalty of perjury as follows:1. I am a Professor of Law at the University of Illinois College of Law, 504 E. Pennsylvania Ave., Champaign, Illinois, 61820. I was born in Chicago, Illinois on March 25, 1950. My area of expertise is in International Law. I am also an Attorney-at-Law in good standing before the Bars of the Supreme Judicial Court of the Commonwealth of Massachusetts and the United States Supreme Court, as well as a variety of United States Federal Courts. I have also practiced law before the International Court or Justice in The Hague, the so-called World Court of the United Nations System. I have attached my Resume to This Affidavit and I hereby incorporate that information herein by reference. See Attachment "1".

2. I have been asked by Ms. Angie Zelter to submit this Affidavit on behalf of her and all other Trident Ploughshares 2000 Protesters in Scotland for consideration by the Honorable Court in their cases. I Have not been paid a fee by Ms. Zelter or by anyone else for the preparation of this Affidavit.

3. I have been asked to address the meaning and significance of the 1996 Advisory Opinion on "The Legality of Nuclear Weapons" by the International Court of Justice. In this regard, attached to this Affidavit is a comprehensive draft article I have written on this Subject entitled "The Criminality of Nuclear Deterrence." I hereby Incorporate this article by reference, and renew and repeat everything I have said therein. I most respectfully request the Honorable Court to read this article and to consider its contents during the course of any proceedings against Ms. Zelter and all other Trident Ploughshares 2000 Protesters in Scotland. The Honorable Court should notice that at the end of the article on page 42 I specifically addressed the criminality of the Trident 2 nuclear weapons system. See Attachment "2". 4. I have also attached to this Affidavit a Transcript of testimony I actually gave in Court,under oath and subject to cross-examination, in a Trident 2 protest case in Ashland, Wisconsin, Wisconsin v. Ostensen, 87 CR 15116. I hereby incorporate this Transcript by reference, and renew and repeat everything I have said therein. I most respectfully request the Honorable Court to read this Transcript and to consider its contents during the course of any proceedings against Ms. Zelter and all other Trident Ploughshares 2000 Protesters in Scotland. I never asked for, nor was I paid, any fee for my Testimony in this Wisconsin Trident 2 Protest case. See Attachment "3".
