Whilst awaiting a reply to most of the points that I raised in my last two letters that have still not been dealt with I would like to bring to your attention the enclosed letter from the Lord Advocate, Colin Boyd, to Austin Mitchell MP.
You will note that it says that Mr. Moynihan was appointed ’in respect of my position’. The enclosed letter from Mr. Moynihan makes it quite clear that Mr. Moynihan sees his position as entirely separate from my position and in fact as being ’to provide assistance to the Court’. Your court’s letter to me of 20th June, signed by Thomas Higgins, your acting deputy, states that Mr. Moynihan’s ’involvement will be determined by the Court’. I have asked both you and Mr. Moynihan to provide me with any communications between the Court and himself that might throw some light on what his actual role will be but to no effect.
It is obviously not only myself who is confused about the actual role that Mr. Moynihan will be playing in the reference proceedings. In the light of the Lord Advocate’s letter to Austin Mitchell and in the light of the court’s responsibility to clarify the role of this amicus curiae, I would like you to clarify in detail what Mr. Moynihan’s role is.
